Terms of Service

These Terms do not replace or change the documents for a specific sale. These Terms explain how our website and buying process work. Each sale is governed by its own documents, which can include the vehicle’s FTC Buyers Guide, the bill of sale, the auction terms you accepted, the limited warranty terms, a trade-in agreement and a financing agreement. If these Terms conflict with any of those documents, that document controls. The bill of sale states the order of precedence among the sale documents.

We own the vehicles we sell and run our own auctions. There are no independent third-party sellers, and members of the public do not sell to each other on our website. Our staff may not bid.

You may create an account with an email address and password, and we may offer other sign-in methods on our sign-in pages. You agree to give accurate information, keep your sign-in details secure, and tell us promptly if you believe someone else has used your account. You must be legally able to enter into a binding contract. Browsing does not require an account.

You must verify your identity before bidding, using a government-issued ID and a photo of you holding it, which our team reviews. Using a sign-in provider does not replace this step. Eligibility to bid can also depend on your account’s standing and your registration state.

No deposit or credit card is required to register or bid.

Every bid is binding. Before each bid you must confirm: “I understand that my bid is binding and I accept this auction’s payment terms.” Placing a bid commits you to buying the vehicle at your bid amount if you win, subject to the auction’s terms. A bid is not a reservation or an expression of interest, and it cannot be withdrawn because you changed your mind.

• Your bid: the amount you enter is your bid, and it must meet the minimum shown. Nothing bids automatically for you.
• Reserve: an auction may have a confidential reserve. If an auction ends with its reserve unmet, the vehicle is not sold.
• Timing: auctions run on our clock, not your device’s. If an auction’s page says so, a late bid can extend the closing time.
• Winning: the highest accepted bid at the close wins, as long as the auction has no reserve or its reserve has been met.
• Auction terms: each auction’s page states its own terms. These apply to that auction and do not change after you accept them, even if our standard terms change later.

We currently sell vehicles by auction and do not currently offer Buy It Now. If a listing offers it in the future, the listing will state the price and terms, and the price section below will apply to that price.

The winning bid is the vehicle price. We charge no buyer premium, auction fee, service fee or platform fee. We absorb card-processing fees and add no surcharge for paying by card. Applicable taxes and government title and registration amounts are separate and are not our fees. Shipping is separate and applies only if you choose delivery.

Your purchase opens at your winning bid, and every remaining step is shown on your purchase page. You choose pickup or home delivery. We confirm the taxes and government amounts and issue your final invoice, and we may ask you to review and accept the final amount. Nothing is payable before your final invoice.

Which rules apply. Each auction’s payment terms are stated on its page and stay with that auction. Auctions published under earlier terms keep those terms. Your purchase page shows the amount due and each available way to pay.

Pickup deposit. Where an auction’s terms state the schedule below, a pickup purchase requires a credit-card deposit after you win and receive your final invoice:

The winning price sets the deposit, and the actual deposit cannot exceed the vehicle price remaining after an accepted trade-in and applicable vehicle-price credits. When card payment is available, you may split the required deposit across multiple credit cards. The deposit is part of the price, not an added charge. A bank transfer does not satisfy a required card deposit under this schedule. Any remaining vehicle balance is paid by bank transfer.

Delivery. A delivery purchase requires no credit-card deposit. The full amount due, including the confirmed transport charge, must be paid before the vehicle is shipped. No delivery charge or date is set until we confirm a quote with you.

Credit-card payments through Stripe. Card payment is available only where your purchase page shows it. Stripe processes card payments and handles your full card number and security code, which we do not receive. Your bank may ask you to authenticate a payment.

Bank transfers. Your purchase page gives the bank details and a payment reference to quote.

When a payment counts. A card payment counts when Stripe confirms it to us. A bank transfer counts once our team confirms it was received. Sending a transfer, or telling us you sent one, does not mark it as paid.

Failed payments. If a card is declined or a payment fails, no payment is recorded. You may try again or contact us. These Terms add no fee for a failed payment.

Release of the vehicle. We release a vehicle only after the payments and signed documents required for that sale are complete.

Pickup takes place at our designated location, and our team confirms the arrangements with you. If the vehicle is kept at another of our facilities, we bring it to the pickup location at no charge, subject to the payment requirements for your purchase. Delivery is an optional paid service. Your purchase page shows any arranged shipment’s progress. Risk of loss before handover or delivery is stated in your bill of sale.

We inspect each vehicle before its auction opens and publish material findings on its listing. Your first accepted bid on an auction opens that vehicle’s complete inspection report to you. An inspection report records what was observed on a stated date. It is not a warranty, an appraisal or a prediction of future condition. Each vehicle’s FTC Buyers Guide states whether it comes with a dealer warranty, and it forms part of your sale contract as your bill of sale describes.

If your vehicle’s Buyers Guide and bill of sale include our limited warranty, the written warranty terms are the only statement of it, including what is covered, its limits, how to request service and how to ask for a review of a denied claim. If a vehicle is sold as is, your Buyers Guide and bill of sale say so, subject to any protections the law requires. Any remaining manufacturer’s warranty belongs to the manufacturer.

These Terms create no separate right to cancel and impose no cancellation penalty. Your rights come from your sale documents and applicable law. For example, the approved bills of sale address a confirmed material discrepancy that was not disclosed before purchase, and damage before handover or delivery.

If a correction or credit leaves you having paid more than you owe, the excess is a refund due to you and will be shown on your purchase. Any refund is recorded against your purchase. These Terms do not set a refund deadline.

Your obligations after winning an auction, and our rights and yours if a purchase is not completed, are governed by the auction’s terms, your sale documents and applicable law. These Terms add no fee or penalty.

If you believe a payment or charge is wrong, please contact us so we can review it. Nothing in these Terms limits any right you have with your card issuer or bank, or under the law. Disputes about a financing account are handled as your financing agreement and account page provide.

Title and registration follow their own steps, and your purchase page shows their progress. We complete and deliver the title documents the applicable laws require. When ownership passes is stated in your bill of sale, subject to applicable title law and the rights of any lienholder named in it. If we finance your purchase, we hold a lien as your financing agreement states.

Offers are made by our team and are valid for the period stated in the offer. They are conditional on inspection and on verification of ownership, title and any loan payoff. If anything is materially different, we will explain it, and you decide whether to accept a revised offer. Any amount you owe beyond an offer is never added to a purchase automatically. A trade-in offer applies toward an eligible vehicle you buy from us, as stated in that offer and any trade-in agreement.

Where offered, Cars of Florida finances eligible purchases itself, subject to application and review. There is no outside lender. Your financing agreement and its disclosures, shown before you sign, are the only statement of your financing terms. Financing never changes the vehicle price.

You agree not to:

• give false information, or use someone else’s identity or account
• bid without intending to complete the purchase
• use automated tools to bid, or try to manipulate an auction
• interfere with our website or bypass its security checks or limits
• use our website unlawfully

We may refuse, suspend or close access to our website or to bidding if we reasonably believe you have broken these Terms, or if needed for security or legal reasons. This does not cancel a binding bid or a purchase already made, or any right you have under your sale documents or the law.

Our website’s content belongs to us or those who license it to us, and you may use it for personal use in connection with our auctions and services. When you upload photos, video or documents, you confirm you have the right to do so and allow us to use them to provide our services, such as evaluating a vehicle or completing a sale.

We may send you notices about your account, bids and purchases by email or through your account, so please keep your email address current. How we handle personal information is explained in our Privacy Policy.

We will post any change on this page and update the effective date. Changes do not rewrite an auction already published or a sale already made.

Nothing in these Terms limits any right that the law does not allow to be limited.
